General Terms and Conditions for Salzburger Lungau GmbH as website operator

1. scope of application and validity

This website is aimed exclusively at consumers within the meaning of Section 1(1)(2) of the Austrian Consumer Protection Act (KSchG) who have reached the age of 18 and have full legal capacity. A consumer is a natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

These General Terms and Conditions (GTC) apply to all bookings made through the travel agency of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland, coordinated by Salzburger Lungau GmbH, available at: www.lungau.at, as well as those made in other ways (in writing, by e-mail or other booking channels as well as by telephone) with the above-mentioned travel agencies as intermediaries or organizers. The travel agencies of the TVB Salzburger Lungau Katschberg and the TVB Tourismus Lungau Salzburgerland offer accommodation providers and private room landlords the opportunity to offer free rooms to guests for booking and, on the other hand, guests the opportunity to book these offered rooms. The guest's booking creates a direct legal relationship between the guest on the one hand and the accommodation provider/landlord on the other. The travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland act as intermediaries and will make all legal declarations of the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland in the name and for the account of the respective accommodation provider/landlord. and money - insofar as payment of the fee is (partially) made via the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland - is collected in the name and for the account of the accommodation provider/landlord. Upon completion of the booking process, the guest thus enters into a direct legal relationship with the respective accommodation provider/landlord and any service disruptions within the framework of the concluded accommodation contract/rental contract are to be settled directly between the accommodation provider/landlord and the guest.

3. contractual relationship between the aforementioned travel agencies and the guest

3.1 The travel agency as intermediary
The travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland offer guests the opportunity to book third-party travel services.
In this context, the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland do not offer any travel services on their own responsibility and assume no liability in this regard. Through the booking, only an agency contract is concluded between the guest and the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland, to which the provisions of § 31b ff KSchG do not apply. The travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland therefore do not owe the guest a (travel) service within the scope of their mediation, nor do they assume any guarantee for the contractual fulfillment by the accommodation provider.

3.2 The travel agency as tour operator
The travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland only offer packages as tour operators in exceptional cases, which are expressly indicated on the corresponding announcements (clearly marked in the offer text as offers of the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland)

4. booking

4.1 Booking for mediated services
In the case of mediated services, reservations are passed on to the relevant accommodation provider via the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland as the messenger of declaration on behalf of the guest.
The mediation by the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland is free of charge for the guest.

4.2 Salzburger Lungau GmbH as the organizer
In the case of travel offers (packages) provided by the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland  as the organizer (and clearly marked in the text of the offer as offers from Salzburger Lungau GmbH), the guest makes his/her reservation directly with the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland.

5. conclusion of the contract

By making a reservation, the guest submits an offer to conclude a contract to the accommodation provider (in the case of mediated services) or the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland (in the case of packages, whereby this is expressly stated in the text of the offer). The contract is concluded upon confirmation by the travel agencies of the TVB Salzburger Lungau Katschberg and the TVB Tourismus Lungau Salzburgerland. If Salzburger Lungau GmbH itself acts as the organizer, the contractual relationship is established between Salzburger Lungau GmbH and the guest. In this respect, the provisions of these GTC and the General Terms and Conditions for the Hotel Industry 2006 shall apply.

6. payment

Once the contract has been confirmed by the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland, the following payment terms apply:

6.1 Payment for mediated contracts
The accommodation provider has the right to demand a deposit as security. If the Proprietor makes use of this right, a corresponding reference shall be made in the offer and/or in the booking. The payment office for this deposit is the accommodation provider. The remaining travel price, as well as any additional costs incurred (final cleaning, local tax, electricity, etc.) are to be paid by the guest directly to the accommodation provider. If a credit card number is provided at the time of booking, the accommodation provider can use this in the event of a cancellation and debit the amount due.

The travel agencies of the TVB Salzburger Lungau Katschberg and the TVB Tourismus Lungau Salzburgerland are not responsible for the (contractual) content (e.g. cancellation fees etc.) of the individual accommodation providers and distance themselves from any liability in this regard.

 

The accommodation provider is solely responsible for the accuracy, up-to-dateness and availability of the rooms. The travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland assume no liability for incorrect bookings.

 

6.2 Payment of package deals from the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland as the organizer
If the travel agencies of TVB Salzburger Lungau Katschberg and TVB Tourismus Lungau Salzburgerland act as the organizer in their own name (especially package deals), the travel price or the deposit must be paid as already shown in the offer, as stated on the booking confirmation.

7. notification of the guest

Guest notifications of changes and cancellations can be submitted to the travel agencies of the TVB Salzburger Lungau Katschberg and the TVB Tourismus Lungau Salzburgerland or the accommodation provider both for mediated services and for services offered by the travel agencies of the TVB Salzburger Lungau Katschberg and the TVB Tourismus Lungau Salzburgerland themselves. The accommodation establishments on this website have their own cancellation conditions.

For the travel agencies of the TVB Salzburger Lungau Katschberg and the TVB Tourismus Lungau Salzburgerland, the cancellation conditions of the AGB Hotellerie 2006 apply.
